Justice In Chamber Declines To Issue Certiorari

The Justice-in-Chamber, Yamie Q. Gbeisay, has declined to issue a petition for Writ of Certiorari, filed by Ministry of Justice against the defendants in ongoing case involving Gloria Musa Scott and others.

Certiorari means a writ or order by which a higher court reviews a decision of a lower court.

The decision was based on a petition filed on July 6 before the high court, requesting to review the Judge Roosevelt Willie ruling on the motion of discovery.

Ministry of Justice further prayed the high court for the issuance of a Writ of Certiorari against the Judge Willie decision, ordering the government to present all evidentiary materials to the lawyers representing defendant Scott and others, far in advance of the commencement of the trial in the case, and should be stopped from proceeding.

The government’s petition revealed that defendant Scott and others were investigated and charged, arrested and indicted by a special Grand Jury for Montserrado County at the close of May, A.D. 2023 Term of Court.

The petition furthered that the ex-Chief Justice and others were indicted for the commission of the crimes of Murder, Criminal Conspiracy and False Reports to Law Enforcement Officers. They were arrested and are currently in detention at the Monrovia Central Prison, awaiting trial.

“By directive of the Associate Justice Yamie Quiqui Gbeisay, presiding in Chamber, you are hereby mandated to resume jurisdiction and proceed to enforce the ruling on the motion. The Justice has therefore declined to issue the writ prayed for by the petitioner,” high court ordered.

Based on the high court order, the Criminal Court “A” commanded both parties and their counsels to appear before the first Judicial Circuit Court on Friday July 14, by 2:00am, for the reading of the mandate from the Supreme Court.
