Another Legal Battle Arising …As Court Summons Cummings, Bility For Damages

The Resident Judge at the Civil Law Court in Monrovia, Kennedy Peabody, has summoned the political leader of the Alternative National Congress (ANC), Alexander B. Cummings and the embattled Chairperson of the Liberty Party, (LP) Musa H. Bility.
Some assigned staffers complained of damage against them at the Monrovia City Court by the thugs believed to have been masterminded by Cummings, Bility and other executive committee members.
The Writ of Summon from the court is mandating the defendants to appear for what it called “Action for Damage” no later than January 28, 2022 and adding “Upon your failure to appear; judgment by default will be rendered against you.”
The complaint was filed by two officers of the Liberian National Police, Patience Kollie and Victoria Davis along with a Monrovia City Police Officer, Victoria Y. Davis, all assigned to the court room for the purpose of maintaining law and order at the court during all legal proceedings.
The plaintiffs’ complained that defendant Cummings after being sued by the All-Liberian Party for Forgery and Criminal Conspiracy at the Monrovia City Court was asked by Judge Jomah Jallah to appear in court on January 6, 2022 following the signing of his criminal appearance bond.
They further explained that the ANC leader and the LP Chairperson failed to adhere to the court’s initial rule on the restriction of people in the courtroom to avoid over crowdedness, instead they decided to appear in a considerate number, though they selected to converge in massive numbers which was prevented by the court officers before the start of the hearing.
According to the plaintiff’s complaint, the defendants instructed their partisans to use the means of force in accessing the courtroom thus leaving the court’s premises in serious chaos with several persons including court officers wounded severely.
Cummings and Bility are to pay for damages as the plaintiffs prayed saying “Your honor and honorable court to hold the defendant liable under the torts doctrine of respondent superior and the defendants be ordered to pay plaintiffs the amount of US$1.5million in general and punity damages to be decided by the jury and grant unto plaintiffs any and all other relief that your honor and this honorable court may deem just, legal and equitable.”
