“We Received Documents From Former President Sirleaf On Sable Mining” -Witness Testifies

The Chief Clerk of the House of Representatives, Mildred Sayon, says she received from Former President Ellen Johnson Sirleaf the draft Public Procurement and Concession Commission (PPCC) Act of 2005 which contains the amended Section 75 and turned said communication over to the Speaker of the House of Representatives.
“I also have the draft amendment and restatement of the PPCC Act that was submitted. I also have the final copy of the amendment and the restatement of the PPCC Act of 2005, approved on September 16, 2010 and published by the authority of the Ministry of Foreign Affairs printed into handbills on September 18, 2010,” she attested.
Testifying as a subpoenaed witness in the Sable Mining Trial ongoing at the Criminal Court ‘C’ yesterday, Witness Sayon said she received the restated instruments accompany with a letter under the signature of the former President, Johnson-Sirleaf, on August 10, 2010 which was placed on the agenda of the House’s plenary the same day.
The subpoenaed witness told the court that she is still in possession of the original copy of the communication by which the amendment and restatement of the PPCC Act of 2005 was submitted to the House through the Speaker J. Alex Tyler.
However, Witness Sayon who attested to have seen Section 75 in the Act while on the cross said, “It was read and referred to the committee that had authority over it; given the time I received it and to the time it was referred, I could not read the entire draft instrument.”
Meanwhile, the contention now is that in Mildred’s testimony, she told the court that she did see the amendment and restatement Act of 2005 but was unable to review the documents in its entirety due to time interval; so prosecution wonders how possible was it that Section 75 that is said to be in the final document is not in the draft law?
The court, however, reminded the government lawyers that the witness had earlier testified that she received the draft law of the amendment and restatement of the PPCC Act of 2005 from the President on August 10, 2010 and the same instrument was placed on the floor of the House and given to the appropriate committee for review.
“So she did not read the entire draft. The said draft speaks for itself as same is before this court at the instant of the prosecution as evidenced to be reviewed by the court. This will do the comparison analysis during the determination of this matter,” the court informed prosecution even though as usual, the government lawyers took exception.
Defense subpoenaed witness’ testimony corroborated with the third witness Alex Tyler’s testimony on the cross when he told the court that on August 5, 2010 he did receive a communication from the former President for review.
“I only knew about the amendment and restatement of the PPCC Act when the President, Madam Ellen Johnson Sirleaf submitted the draft PPCC Bill through a cover letter to the Legislature for enactment. The House went through the normal formalities; passed the draft law as it was sent by the President and forwarded to the Senate,’ he explained.
The former Speaker, Tyler said , “The Senate then passed it as it was sent to them by the House with no ‘T’ crossed or ‘I’ dotted meaning there was no change, no addition, no subtraction and forwarded said to the President after the necessary signatures it could have obtain from the Legislature for approval.”
“There is no way, I could have conspired with the other co-defendants to alter or insert any section to give the Minister of Lands, Mines and Energy at the time the power to declare a non-bidding area. The allegation is a complete falsehood,” Tyler reiterated.
He testified claiming, “I was cooked by the Master Chef without putting any ingredient in it because there was no ingredient to be out there. This was just a calculated plot by the government of the day and the President at the time to tarnish our hard earned reputation and those of my fellow indictees.”
