Government lawyers are seeking the re-arrest of the former Defense Minister, Brownie Samukai and his deputies for deceptive property valuation bond.
The defendants Brownie Samukai, Joseph Johnson and Nyumah Dorbor were charged with the commission of the crimes of Economic Sabotage, theft of property, misuse of public money, Criminal conspiracy and money laundering for allegedly stealing the amount of USD$1,259,462.00.
Government lawyers said that the defendants have filed property valuation bond to secure their release and same has been approved by judge Dixon.
Reading the 6 counts document, government lawyers stated further that the passing on the provision of the statue obtaining bail for the crime of economic sabotage, the Honorable Supreme Court opined that an accused person should have the right to choose any one of the four modes provided for under section 63.1 of the civil procedure law which states “cash, unencumbered real property on which taxes have been paid and which is held in fee by the person furnishing the bond, valuables to the amount of the bond which are easily converted into cash or sureties who meet the requirements of section 63.2’’ .
According to Government lawyers the properties values on the bond were never assessed by the real Estate Tax Division of the Liberia Revenue Authority. The values that were placed on the properties are self-declared with the intent to deceive the court so as to meet the legal sufficiency of the bond.
Prosecution’s continued that there is no evidence of an evaluation report from the LRA and to this effect, prosecution gives notice that it will produce witnesses from the LRA to testify to the effect that assessment was made by the defendants with bad intent and not from the LRA physical verification as provided by law.
Prosecution’s revealed that there is no evidence of tax payment receipts from the LRA covering the period up to and including December 31 and there is no affidavit to authenticate that these properties are not used as collateral with any commercial banks within the Republic of Liberia so as to indicate that there is no lien or encumbrances on the properties.
